Membership Terms & Conditions – General

Ticketek sells tickets as an agent for promoters, venues or managers. It has no control over venues or acts. While Ticketek will make arrangements for refunds in appropriate circumstances, complaints in relation to varied or cancelled events should be directed to the promoter of the relevant event. Privilege Club membership benefits may be subject to certain specific restricted conditions of sale in relation to an event imposed by the promoter of that event.

  1. By joining Privilege Club, you agree to be bound by these Terms and Conditions of membership. You acknowledge that these Terms and Conditions apply on each occasion on which you purchase tickets from Ticketek using Privilege Club.
  2. Ticketek reserves the right to change or vary these Terms and Conditions whenever it deems it appropriate (including the right to introduce new or increased fees and charges relating to memberships and ticket purchases). All reasonable endeavours will be used to give notice to members of any such changes. By exercising any of the benefits of Privilege Club membership after being notified of a change to these Terms and Conditions, you agree to be bound by that change.
  3. Each ticket for an event is sold subject to Ticketek's normal Terms of Sale. These conditions may be varied by Ticketek from time to time without notice to you.
  4. The Privilege Club membership fee is payable annually.
  5. A premium access fee may be charged to Privilege Club members in addition to Ticketek’s standard fees and charges.
  6. The Privilege Club membership card is not a credit card and no credit is available to members from Ticketek. Each Privilege Club member must hold a valid Bankcard, MasterCard, Visa, Diners Club or American Express Card and all bookings will be charged against the credit card nominated on the Privilege Club application form, or such other credit card nominated at the time of booking and acceptable to Ticketek.
  7. Ticketek does not guarantee that premium seating, pre-booking services or any other membership privileges will be available in relation to any given event. Tickets may not be available in all price levels or sections for a particular event.
  8. Tickets will be held in the name of the Privilege Club member. When collecting tickets, identification such as driver’s license or credit card must be shown.
  9. Ticketek has no liability in respect of any tickets duly posted by Ticketek at your request or at the request of a person correctly quoting your Privilege Club member number which are lost in transit or are otherwise not received by you.
  10. Ticketek is a ticketing agent in respect of the relevant event. Ticketek has no liability to Privilege Club members in respect of any cancellation, postponement or variation of the event. No refunds or exchanges on any ticket will be provided except in accordance with the LPA Code of Practice for Event Ticketing in Australia (www.liveperformance.com.au).
  11. The sale of tickets for particular events may be governed by restricted or additional conditions of sale, including those imposed by relevant legislation in the state in which the event is being staged. These conditions will generally be published by the promoter of the event, displayed on the unique event page for that event and may also be stated on the actual ticket. These additional conditions are binding on Privilege Club members who purchase tickets for the relevant event.
  12. Seating plans are subject to change by the promoter or venue or through other circumstances beyond the control of Ticketek. Ticketek shall have no liability to you or to any other person for any loss or damage you or any other person suffers as a result of such a change.
  13. Any change to your address, email address, telephone or other details must be updated through the "My Membership" page of the Privilege Club website (https://privilegeclub.com.au/Login.aspx) within 14 days of such change occurring.
  14. Privilege Club membership is personal to the member and is not transferable.
  15. Membership fees will not be refunded in the event of a cancellation of Privilege Club membership.
  16. To the extent permitted by law, Ticketek excludes all conditions and warranties implied into these terms and conditions by law. Where Ticketek is not able to exclude such conditions at law, Ticketek’s total liability in relation to a breach of such a condition or warranty is, to the extent permitted by law, limited, at Ticketek’s option, to a refund of the price of the good or service the subject of the warranty, the resupply of the good or service the subject of the warranty, or the payment of the cost of having the good or service the subject of the warranty resupplied.
  17. Subject to paragraph 16, Ticketek’s total aggregate liability to you for anything arising out of or in relation to your membership or any tickets purchased pursuant to your membership or your attendance or non-attendance at any events that you or any other person have bought tickets for from Ticketek, whether in tort, contract or otherwise is limited to the amount of your Privilege Club membership fee for the first 12 months of your membership. Ticketek has no liability for special, indirect or consequential damages of any kind, regardless of how such damages may arise.
  18. Tickets purchased may not, without the prior written consent of Ticketek, be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the bearer of the ticket may be refused admission.
  19. Members acknowledge that it is a serious breach of these Terms & Conditions if tickets purchased through Privilege Club are resold at a premium. If tickets purchased through Privilege Club are resold at a premium, Ticketek reserves the right to cancel a member’s membership without notice and without refunding any membership fee.
